Calma — Terms of Use
Version 1.0 · effective ⚠ EFFECTIVE_DATE
This is an English translation provided for convenience. In case of any discrepancy, the Polish version at https://calmaai.net/terms prevails.
1. General
1.1. These Terms govern the use of the Calma mobile application (the "App") and the paid services offered within it.
1.2. The provider is ⚠ OPERATOR_NAME, ⚠ OPERATOR_ADDRESS, VAT ID (NIP) ⚠ NIP, ⚠ OPERATOR_REGISTRY (the "Provider", "we").
1.3. Contact: support@calmaai.net · website: https://calmaai.net.
1.4. These Terms are made available free of charge at https://calmaai.net/terms in a form that allows you to retrieve, reproduce and store them.
2. Definitions
- User — a natural person using the App.
- Account — the User's data set in the App, linked to an email address or to a third-party login account.
- Diary — the record of consumed meals and their nutritional values kept in the App.
- AI Scan — analysis of a meal photo by an artificial-intelligence model returning an estimated dish name, weight, calories and macronutrients.
- AI Correction — a change to an AI Scan result based on the User's free-text description ("no dressing", "add 50 g of rice").
- Free plan — use of the App without a subscription, to the extent described in section 5.
- Premium — the paid subscription that removes the AI Scan and AI Correction limits.
- App Store — the Apple App Store operated by Apple Inc. and its affiliates.
- Consumer — a User who is a consumer under Article 22(1) of the Polish Civil Code.
3. Technical requirements
3.1. You need: a mobile device running a supported version of iOS, an internet connection, an Apple ID (for purchases) and a working email address.
3.2. The AI Scan feature requires an internet connection and permission to access the device camera or photo library.
3.3. The Provider does not cover data-transfer costs or your mobile operator's charges.
4. Account
4.1. Using the App requires an Account. You register with an email address and password (the address is confirmed with a one-time code) or by signing in with a third-party provider (Google, Facebook, X).
4.2. After registration you complete a short onboarding survey (first name, date of birth, sex, height, weight, activity level, goal). The App uses it to calculate an indicative daily calorie limit and macro split. Providing this data is voluntary but necessary for the limit calculation to work.
4.3. The App may be used by persons aged 16 or over. Users under 18 may use the App with the knowledge and consent of their legal guardian, and may make in-app purchases only with that consent.
4.4. You agree to provide true and current data and to keep your password safe. One Account belongs to one person; sharing an Account is not allowed.
4.5. You may delete your Account at any time — in the App (Account settings) or by writing to support@calmaai.net. Section 16 describes the consequences.
5. Scope of the service
5.1. The App lets you, among other things:
- count calories and macros from a meal photo (AI Scan),
- edit the AI result: change weights and add or remove ingredients before saving,
- use AI Correction based on a free-text description,
- add products and dishes manually with weight and per-100 g values,
- build your own dishes from ingredients and define custom portion sizes,
- save meals to the Diary (breakfast, lunch, dinner, snack),
- keep favourites and a list of recently added items,
- view daily, weekly and monthly statistics,
- schedule local meal reminders.
5.2. The Free plan gives full access to the App's features with a limit of 3 AI Scans and 6 AI Corrections per Account. The limits are enforced server-side and do not reset when the App is reinstalled.
5.3. Once the limit is used up, further AI Scans and AI Corrections require a Premium subscription. All other features (manual entry, Diary, custom products and dishes, favourites, statistics) remain available without a subscription.
5.4. The Provider may develop the App, add and change features and — subject to section 17 — change the scope of the Free plan going forward. Such a change does not remove features covered by a subscription already purchased and paid for in the current billing period.
6. Nature of the information — not medical advice
6.1. The App is an informational tool that supports keeping a food Diary yourself. The App is not a medical device and is not intended to diagnose, treat or prevent any disease.
6.2. Content shown in the App, including the calculated calorie limit and macro split, is not medical, dietetic or nutritional advice and does not replace a consultation with a physician or dietitian.
6.3. The App is not intended for people who require medically supervised nutrition, in particular people with diabetes, eating disorders or metabolic conditions, nor for pregnant or breastfeeding women. Consult a specialist before changing your diet.
6.4. You make dietary decisions yourself and at your own risk.
7. Artificial intelligence — rules and limits
7.1. An AI Scan result is an estimate, not a laboratory measurement. Its accuracy depends on photo quality, framing, lighting, how recognisable the dish is and whether the ingredients are visible.
7.2. Every AI result stays editable before it is saved to the Diary. You decide what is finally recorded.
7.3. The Provider does not warrant that an AI result matches the actual composition or nutritional value of a meal and does not guarantee any particular level of accuracy.
7.4. A photo submitted for an AI Scan is processed by the AI model provider named in the Privacy Policy. You should not submit photos showing third parties, documents or any other information unrelated to the meal.
7.5. An AI result is not an automated decision producing legal effects concerning you within the meaning of Article 22 GDPR.
8. Premium subscription
8.1. Subscription prices (VAT included):
| Plan | Price |
|---|---|
| Monthly | 29.99 zł / month |
| Yearly | 89.99 zł / year |
8.2. Current prices and billing periods are shown in the App before purchase and on the App Store product page. In case of a discrepancy, the price shown in the App Store at the moment you confirm the purchase applies.
8.3. Subscriptions are sold through the App Store. Payment is charged to your Apple ID account upon confirmation of purchase. The Provider has no access to your payment card data.
8.4. The subscription renews automatically for another period of the same length and at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period. The renewal charge is taken within 24 hours before the new period starts.
8.5. You manage the subscription, including cancellation, in your Apple ID account settings. Cancelling stops future renewals; Premium stays active until the end of the period already paid for.
8.6. The Free plan does not include a trial period. If a trial is offered in the future, its terms (length, price afterwards, cancellation rules) will be presented in the App before purchase, and any unused part of a trial is forfeited if a subscription is purchased earlier.
8.7. You will be informed about a price change in line with section 17 and App Store rules. A price change does not affect the current, already paid billing period. If you do not accept a new price, you may decline the renewal before the current period ends.
8.8. The Provider uses a subscription-management provider (RevenueCat) to verify purchase status and grant Premium entitlements in the App.
9. Right of withdrawal
9.1. A Consumer may withdraw from the digital-service contract within 14 days of its conclusion, without giving a reason.
9.2. The right of withdrawal does not apply where the Provider has fully performed the digital service and the Consumer was informed before performance began that they would lose the right of withdrawal once the service is performed, and acknowledged this (Article 38(1)(1) and Article 38a of the Polish Consumer Rights Act). Starting to use Premium features within the 14-day window is treated as a request for immediate performance.
9.3. Because subscriptions are sold through the App Store, refunds and payment complaints are handled by Apple under its own rules; request a refund at reportaproblem.apple.com. You may also send a withdrawal notice or complaint to support@calmaai.net and we will help you pursue it.
9.4. No special form is required: an email to support@calmaai.net clearly expressing your intention to withdraw is enough.
10. User content
10.1. The data you enter — meal photos, product and dish names, Diary entries, nutritional values, profile photo — remains your content ("User Content").
10.2. You grant the Provider a non-exclusive, royalty-free licence to store, reproduce and process User Content only as needed to provide the service: to display it in the App, run an AI Scan, keep your Diary and statistics, maintain backups and handle support requests. The licence ends when the data or the Account is deleted.
10.3. Products and dishes you add may be included in the App's shared product database and made available to other Users in a de-identified form (product name and nutritional values) — never together with your Diary, meal photos or Account data.
10.4. The Provider does not use User Content to train artificial-intelligence models. How the model provider processes data is described in the Privacy Policy.
10.5. You represent that you hold the rights to the content you submit and that it does not infringe third-party rights.
11. Prohibited use
The following is prohibited in particular:
- using the App in a way that breaks the law or infringes third-party rights,
- circumventing Free-plan limits, subscription verification or App security measures, including creating multiple Accounts for that purpose,
- automated, bulk or excessive invocation of AI features (including via scripts and bots),
- interfering with the App's code, reverse engineering beyond what the law permits, or loading the infrastructure in a way that disrupts the service,
- submitting unlawful or offensive content, or content containing third-party data without a legal basis,
- reselling, renting or sharing Premium access with third parties.
In the event of a material or repeated breach, the Provider may — after prior notice, or immediately in case of serious breaches — restrict access to AI features or block the Account. You may then file a complaint under section 15.
12. Intellectual property
12.1. The App, its code, interface, graphics, mascot, the Calma name and logo and the product database are the Provider's property or are used under the appropriate licences.
12.2. You receive a limited, non-exclusive, non-transferable and revocable right to use the App on your own device for personal, non-commercial purposes.
12.3. These Terms transfer no intellectual-property rights in the App to you.
13. Availability and conformity with the contract
13.1. The Provider makes reasonable efforts to keep the App continuously available and reserves the right to temporary downtime for technical work, updates and maintenance.
13.2. The Provider supplies the updates necessary to keep the digital service in conformity with the contract and informs you about them. Not installing updates may affect how the App works.
13.3. The Provider is liable to a Consumer for the conformity of the digital service with the contract under Chapter 5b of the Polish Consumer Rights Act. Where the service is not in conformity, the Consumer may demand that it be brought into conformity and, in the cases set out in that act, a price reduction or withdrawal from the contract.
13.4. A difference between an AI estimate and the actual composition of a meal is not a lack of conformity, provided the feature works as described in section 7.
14. Liability
14.1. The Provider is liable for non-performance or improper performance of the service under the general rules of Polish law, including consumer-protection law.
14.2. The Provider is not liable for: the consequences of dietary and health decisions you make, data you entered incorrectly, the operation of your device, operating system, network or the App Store, or for a paid subscription period you did not use for reasons attributable to you.
14.3. Towards Users who are not Consumers, the Provider's liability is limited to actual damage and to the amount of fees paid in the 12 months preceding the event; liability for lost profits is excluded. These limitations do not apply to damage caused intentionally or where excluding liability is not permitted.
14.4. Nothing in these Terms excludes or limits Consumer rights under mandatory provisions of law.
15. Complaints and dispute resolution
15.1. Complaints about the App and the paid services can be sent to support@calmaai.net and should include: the Account email address, a description of the problem and the outcome you expect.
15.2. The Provider reviews a complaint and replies within 14 days of receiving it, to the email address it was sent from.
15.3. A Consumer may use out-of-court complaint and redress mechanisms, including the permanent consumer arbitration court, the regional inspector of the Trade Inspection, the district (municipal) consumer ombudsman, or a consumer organisation.
15.4. Consumer information is available from the Polish Office of Competition and Consumer Protection: uokik.gov.pl.
16. Termination and Account deletion
16.1. The contract for using the App is concluded for an indefinite period and may be terminated by you at any time by deleting your Account.
16.2. Deleting the Account permanently deletes Account data, the Diary, your own products and dishes, favourites and meal photos, within the periods set out in the Privacy Policy. The operation cannot be undone.
16.3. Deleting the Account does not by itself cancel a subscription purchased through the App Store. To stop future renewals, turn off auto-renewal in your Apple ID settings.
16.4. The Provider may terminate the contract with 30 days' notice if the service is discontinued; any unused, paid part of a subscription will then be settled pro rata as required by law.
17. Changes to these Terms
17.1. The Provider may amend these Terms for justified reasons, in particular: changes in law, changes to the scope or manner of providing the service, price changes, changes to App Store requirements, or the need to counter abuse.
17.2. You will be informed about changes to the Terms or prices at least 14 days before they take effect — in the App or by email to the address linked to your Account.
17.3. Continuing to use the App after a change takes effect means you accept it. If you do not accept it, you may terminate the contract under section 16 before the change takes effect.
18. App Store provisions
18.1. The contract for using the App is concluded solely between you and the Provider; Apple is not a party to it.
18.2. Apple has no obligation to furnish any maintenance or support services for the App. Support is provided by the Provider at support@calmaai.net.
18.3. If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
18.4. Apple is not responsible for any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, claims under consumer-protection or privacy law, and intellectual-property infringement claims.
18.5. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties, and that you will comply with applicable third-party terms when using the App.
18.6. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
19. Governing law and jurisdiction
19.1. These Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection of mandatory provisions of the law of their country of habitual residence.
19.2. Disputes with a Consumer are heard by the courts having jurisdiction under the Polish Code of Civil Procedure. Disputes with Users who are not Consumers are heard by the court having jurisdiction over the Provider's registered seat.
20. Final provisions
20.1. Personal-data processing is described in the Privacy Policy at https://calmaai.net/privacy.
20.2. If any provision of these Terms is found invalid or ineffective, the remaining provisions stay in force.
20.3. The current version applies from the date given at the top of this document. Earlier versions are available on request at support@calmaai.net.
